The company MUSIC CARE performs personal data (hereinafter “PD”) processing in compliance with the applicable legal provisions and notably with Regulation (EU) 2016/679 known as the “GDPR”.

The PD for which MUSIC CARE is the controller primarily relate to its customers, prospects, partners and employees.


The PD in question primarily include identification and location data (name, telephone numbers, e-mail, addresses, IP, etc.), as well as data related to personal, professional and financial aspects of these people (marital status, profession, bank account information, etc.).


All PD processing by MUSIC CARE is for a specific purpose as described below.


Failure to provide the required PD may prevent MUSIC CARE from fulfilling each processing purpose.


PD processing by MUSIC CARE is performed with the individual’s consent, insofar as possible, or when this consent is not collected, only for the strict purposes of fulfilling contracts and/or meeting legal obligations.


MUSIC CARE protects the PD through physical and technological means that serve to guarantee their security, confidentiality, integrity and availability, in compliance with the legal requirements.


The recipients of these PD are the MUSIC CARE company and its employees and subordinates, and possible professional partners under contract with MUSIC CARE that are necessary in order to fulfil the relevant processing purpose.


These recipients guarantee the same degree of PD protection as MUSIC CARE.


Relative to their PD, individuals have the right to ask MUSIC CARE for access, rectification, deletion, limitation, portability of their PD according to the terms and conditions determined by the applicable legal provisions and in particular the GDPR Regulation.


They also have the right to object at any time to the use of their PD for prospecting purposes.

B. Condition specific to the PD that YOU personally provide to MUSIC CARE via the website www.music-care.com, when:


1. You ask a question on our “Contact” page.


These PD provided by you are processed by MUSIC CARE with your formal consent on the legal basis of article 6 §1 a) of the GDPR in order to answer your questions about the services offered by MUSIC CARE.


These PD are retained by MUSIC CARE for the time needed to answer your questions. They will then be erased.


At any time by written request sent to the contact person indicated above, you may withdraw your consent to the processing of your PD.


The withdrawal of consent will not affect the legality of the processing prior to the withdrawal date.


On the other hand, it will prevent MUSIC CARE from fulfilling the purpose(s) indicated above.


2. You buy Music Care Services online on our “Registration” page.


These PD are processed by MUSIC CARE on the legal basis of article 6 §1 b) of the GDPR, in order to meet its contractual obligations relative to you in the context of the orders and subscriptions submitted by you on the site.


These PD are retained by MUSIC CARE for the duration of the fulfillment of the contract relating to your orders and subscriptions and during the limitation period of any action (whether in contract or tort) relating thereto.


3. You indicate that you wish to receive newsletters and commercial offers related to our activity.


When on our site, you tick the box:


'I formally consent to the use of my data provided here for the purpose of sending me newsletters and commercial offers related to the activities of MUSIC CARE.'


You formally consent to the processing of your PD by MUSIC CARE for marketing purposes.


The PD provided by you are processed by MUSIC CARE with your formal consent on the legal basis of article 6 §1 a) of the GDPR, notably in order for you to be sent:


- information on the activities and offers of MUSIC CARE;


- commercial offers related to its activity.


These PD will be retained for the duration of the activity of MUSIC CARE or until you oppose this processing by clicking on the following link “delete my personal data from this file” contact@music-care.com or on the link with the same name contained in the mailings related to this file, or by submitting a written request to the contact person indicated at the start hereof.


The withdrawal of consent will not affect the legality of the processing prior to the withdrawal date.


On the other hand, it will prevent MUSIC CARE from fulfilling the purpose(s) indicated above.


C. Specific conditions when MUSIC CARE acts as PROCESSOR of the PD of patients/clients entrusted to it by its professional clients.


As part of the services provided to professionals by MUSIC CARE, its clients/partners are sometimes required to transfer PD from their own clients/patients to MUSIC CARE. MUSIC CARE then acts as the processor for the purposes of the GDPR.


The controller of these PD is therefore not MUSIC CARE but its client/professional partner who will have transferred the PD, which alone is responsible for the protection of these PD within the meaning of the GDPR, and in particular for the information of individuals regarding this transfer and processing, as well as the exercise of the individual rights relating thereto.

Upon completion of the services, these PD are destroyed by MUSIC CARE.
